Question

We are a preschool and recently removed a family for violating our 3 bite policy. During the meeting the family threatened to use social media to hurt our reputation. The family has now posted in an online group with over 1000 local Moms sharing her displeasure with us. Some of which she says is true in terms of asking her to leave immediately, a lot of other information is false. Can I send a cease and desist letter? Should I consult an attorney regarding defamation or libel (is it worth the trouble)?

Answer

Sure you could send a C&D letter, but as for consulting counsel

regarding a possible defamation claim, I'd say you would

likely be wasting your time and, perhaps, money as well.

And, of course, you should also be able to post on this social medial site whatever your appropriate rebuttal might be with respect

to this disgruntled family's claims.
