Question

I have three siblings, my father died in 2005, I was his caretaker, personal representative of his estate. My Dad left everything to me, as stated in his will. My Dad died of lung cancer from working in the shipyard most of his life. He was receiving monies from claims before his death. Now all the monies from these claims come to me as stated in his will that I get his entire estate. Now that my sister is retired, she believes that these claims should be split between all four siblings regardless of what the will states. She does not know that I have been receiving monies which are sent to me in my name. My question is: Since the will states that I am entitled to his entire estate, would these claims filed on my dad's behalf, become solely mine?

Answer

An estate should have been opened to deal with the proper transfer of assets and payment of claims. You need to consult with a probate attorney regarding these claims and how to handle them.
