I started an eviction process against my tenant due to the lack of rent payment since February, we have a lease for one year that ends in june, he hasn't paid since january. Can I send him a 30 day notice to leave the property due the termination of the contract? I don't care if he's in the middle of an eviction process I want him out of my house.
Answer
Your post does not make any sense. An eviction for nonpayment of rent is legally done with a three day pay or quit notice. After expiration of the required time, the landlord files an unlawful detainer action to get a judgment of possession, which will allow the sheriff to evict the no paying tenant. You state you started an eviction, and you now want to delay it with a longer notice?
