Can my mother get gaurdianship over my child without my consent? And also how long does temporary gaurdianship last? The reason I'm asking is because in November I recieved a letter/petition in the mail saying she has temporary gaurdianship of my child, I live with get but plan on moving on my own next month and she told me I can't take my child is this legal? How do I go about solving this problem?
Answer
You were entitled to notice of the proceeding where grandma was given temporary guardianship. As she has temporary guardianship, she has sole control over your child. You have to go to court (with appropriate notice to grandma and her atty) and ask that the order be vacated or modified. You should have been given papers regarding the proceeding. If you were not, ask grandma for a copy of the order, which will tell you what court to go to.
