In a wrongful death lawsuit, must the executor sign a contract with the law firm? I'm being asked by the beneficiaries to be the executor but I am not a litigant in this case. The law firm wants me to sign the contract for lawyer client confidentiality purposes. I don't want to be liable for ANY costs/expenses/percentages of this law suit.



Answer

In most cases the executor is the one who needs to pursue a lawsuit. Other heirs shouldn't be hiring lawyers for the estate. Discuss this with the lawyer you hired to assist you with probate (and if you have an estate with a wrongful death claim and do not have a lawyer, you need one ASAP).
