If a mother is renting from us (no official contract) and has a child that is in custody of the father and that person is wanting to the child (he lives in NC and is wanting the girl to be with him) but he doesn't know where she is at, could we be liable if something happens to the little girl (like falling down/ breaking a leg etc...) if we own the house?

As a landlord you ought to have premises liability insurance. If it could be shown that the injuries to the child were proximately caused by some condition you neglected to repair or the general habitability of the premises you could be held liable. Regardless of whether there is a lease or not you are a landlord in fact.
