My son in now 16 (15 when relationship started)and his girlfriend is 14(14 when relationship started) are one year apart in school 9th and 10th grades. are having sex are there any legal problems with this act.

The answer is complicated because of some confusing law changes. In general the age of consent is 18, but with exceptions for close in age encounters. There is sort of a clear answer that at 16 a person can consent to sexual activity with anyone between 16 and 23, and a clear answer that couples within 4 years of each other (over the age of 14) are not eligible for consideration as sex offenders. In general prosecutors will not pursue consensual activity between a pair separated by a year. But It may still be possible to face legal issues because no court has come out and said this can not be pursued.
