The father of my son has never paid child support in our son's 15 years. I even have a signed Affidavit saying he would support our son from birth until his 18th birthday, which he never did. So, can I use that to make him pay for our son's university tuition?



Answer

You must file a Paternity case, document may be admissible but the Judge normally can only go backwards for two years before the filing date. Also the Father may say you waived support due to the delay.

You have to file a petition with the court. Use of a lawyer is recommended.
