In Virginia, do misdemeanor traffic charge failing to yield right of way be tried without a lawyer ? Even if defendant ask for a lawyer ?



Answer

Failure to yield the right of way is not a misdemeanor offense under

the Criminal Code of Virgina but rather a traffic infraction, and, as such,

a conviction for such a violation does not carry with it any imposable jail time,

and consequently a traffic court hearing such a matter is not required to appoint the accused violator an attorney, even if he asks for one.
