Question

We signed a prenup in CA in order to keep all assets, income and liabilities separate. 5 years later we are filing uncontested divorce. Should any asset be considered community property in our marital settlement agreement?

Answer

This question can only be answered after a careful review of the prenuptial agreement with an experienced family law attorney.

Answer

I agree with Ms. Kock. For all we know, the prenuptial agreement was not properly executed and is invalid.
