I Recently purchased a BMW car with warranty provided by 3rd party from a dealer. The car has few issues that as per BMW would cost around 2K and it is not covered under warranty. I also discovered that car warranty voided by BMW (not sure why and they not disclosing). I immediately asked asked dealer to take the car back but he is not taking it back. Now after few follow ups with BMW I found this car has actual mileage of 93K+ when the odometer and carfax shows 31K. As per BMW it is mileage discrepancy and some one have reversed the odometer to reduce the actual mileage.

I feel I am completely cheated by the dealer and I am looking to take this against him. I have already submitted a complain in consumer affair but they are very slow and it is been a month since they handling this case.

The car is sitting in my parking lot as I am unable to drive until the issues are fixed and I am not willing to spend any money thinking they may go vest when dealer take the car back. I am still paying money on the car as I have to pay for the insurance and loans installment, parking space and I can't buy other car until this is resolved so I have to relay on other sources for what I needed the 2nd car.

The dealer might have not modified the odometer but he defiantly sold me a car that have fabricated mileage. And he certainly responsible for all the pain I am going through now. What are my options how can I take it hard on dealer and take all my money back from him.
