You can sue anybody anytime for anything. The real question is whether it's worth it. The only way to figure that out is to talk to an experienced medical malpractice atty. I don't handle med-mal cases, but if you want a referral in your area, call me.

As noted above, you can sue anyone, but the question is whether you have a good basis for a lawsuit.
