Question

Answer

Yes. However, it is secondary to other PIP that may be on the vehicle you were driving. That is, you must first verify whether there was PIP on the vehicle you were driving, If so, that PIP is primary and your PIP is secondary.

You need to be careful about how PIP works in relation to the remainder of your claim, especially if you might have an uninsured/under-insured motorist claim, health insurance, Medicare, Medicaid, etc.

Have you considered calling an attorney for a free consultation? A lawyer can help you keep more of you PIP rather than having your doctors collect it all. It wouldn't hurt if you call and (at the very least) get a free, no obligation, consultation.
