have demand note in fl that states each maker and endorser severally waives demand, protest, and notice of maturity, non payment or protest and all requirements necessary to hold each of them liable as makers and endorsers. how long do i have in statutes of limitations to file action on this note for payment?
Answer
The statute of limitations for a written contract is five years from the date of the last payment. However, if your note was not signed properly, or did not state all of the necessary things, then it might be considered an unwritten contract, in which case the statute of limitations would be four years. There might be other issues that shorten that further. You should really consult with an attorney who practices in this area of the law. Our office is in South Florida and we offer a free initial consultation. I am one of only about 235 attorneys in Florida who are board certified in business litigation, which indicates that I am an expert in handling business litigation matters.
