i have my 3 children every weekend of a calendar year. And every other week in the evenings and following mornings. Attorneys i have spoken to in the past have told me that although i am not listed as the custodial parent on divorce decree, i am still able to claim them as dependents for annual tax purposes because i DO have them most of the time and I DO pay child support. Is this an accurate statement? Thank You!
Answer
I believe the rule is the parent with the most time gets the deduction. Since you are not the "custodial" parent, you should keep documentation.
