Should I challenge a traffic ticket in court if I provide evidence that I was not operating the car at the time of the incident (traffic camera caught running red light)? I know for a fact that it was my sister operating the car but I'm being fined because it was my car and shes refusing to pay. What is the likelihood that if I challenge the ticket in court I'll actually win, and what will happen if my sister is proven guilty of operating my car without permission?
Answer
Bear in mind that that kind of ticket does not carry any points. No one can predict what will happen if you fight the ticket. You can request a trial by pleading not guilty and the judge will hear the case. I guess you just tell him your sister was driving your car without your permission. It would be nice if she would just pay it and own up to it. Explain to your sister that it doesn't carry points. Just do not ignore the ticket because if you do a warrant will eventually issue for your arrest and your license could be suspended for not paying it. Beyond a fine that is probably the worst that will happen.
