I have been running a business as a partner, I am not on anything as an owner...the owner has not been involved in the business at all in seven months....we are about to receive a big check from work I have preformed along with my employees...the owner is coming into town to get the check and liquidate the company can I stop this from happening?
Answer
You can immediately file in the Common Pleas Court a motion to stop the proceeds from being distributed, and the partnership from being dissolved, until the court makes a determination about the legal relationship between you and the owner. You can actually request that the company be put in the hands of a receiver who will manage the property and proceeds.
If you try to do this you should have ample proof that you are actually a partner and not an employee. You would need some kind of writing to prove this. Feel free to contact me at my cell phone to discuss this. 216.952.1990
