Question

I was involved in a situation where myself and one other guy, were held at gunpoint for robbery the other guy wrestled the gun away and beat him up and took his wallet. We were both charged with federal assault aggravated battery but the co defendant confessed everything to his ex wife, and she made a statement to the police. He stated that he got the gun away from him beat him up severely and thought he had killed him, and then took his wallet.

This confession that was made to the co-defendents ex wife and she consequently made a statement to the police was not in the discovery. It was accidentally attached to my daughters case, who has the same last name as I do, and her case is unrelated. I believe that the prosecutors tried to hide this statement because the co defendant agreed to a plea to testify against me and I believe they want to hang it all on me because I am in a 1% motorcycle club. My court appointed attorney I believe maybe in on the conspiracy because he is stating that the confession has no relevance to my case. My question is do I qualify to ask the court to appoint me another court appointed attorney because this attorney I currently have obviously does not have my best interest at heart

Answer

You can ask the Court to appoint a new attorney, because you and the present attorney don't cooperate well.

Good luck
