Is it illegal for an employer to hold your check until you sign a non-compete agreement - even though it wasn't a release agreement and it didn't include any language that would give any "rights" away? It merely said not to disclose or use any of the employer's confidential info.



Answer

If you earned the wages, you are entitled to them. If you can't convince your employer to pay you, you can go to the State Department of Labor (EDD) and make a wage claim. You might be entitled to a penalty payment as well. Of course, not signing the agreement might not endear you to the employer.
