I was ordered to pay Alimony for 10 years- and it started 7 years ago ($400 per month). My ex wife has always worked, making almost as much as I had. Since we divorced she has finished schooling so she very well could make the same as I do now. I am now remarried and for the last few months, the alimony payment is the last payment I make, and some have been skipped. I got served papers yesterday for an "order to show cause" on why I haven't paid. Is there a way to get the Alimony removed? and if not what can I expect from the court hearing? I also overpaid my child support and paid for 6 months after my daughter turned 18 but dropped out of school- i had told my ex wife that i wanted credit for that- is that possible?
Answer
You are entitled to a credit for all overpayments. You should also respond to the OSC with a petition to modify to get the alimony set aside.
