How many days prior to a Court Hearing do you have to have all paperwork filed and served to the other party?



Answer

Normally all papers supporting a motion or request for order in family law must be served on the other party at least 16 court days prior to a hearing, unless ordered otherwise. Note that I used the term "court" days, which do not include weekends and judicial holidays. Also note that different time periods may apply depending on what kind of hearing you are having, or if the court orders a different time period.
