Question

If me and my husband were using the same lawyer to file an uncontested divorce and

then my husband decided to not agree to the terms and then says the lawyer is his and that I have to get another one is that legal for the lawyer that was helping us both to switch sides and be only his lawyer?

Answer

If you have communicated with the lawyer then he should withdraw from representing either one of you.

Answer

It is unethical for any attorney to represent both sides in a divorce. That said, I often represent one spouse but meet with the other spouse once I've made it clear to both parties that I can only represent one side. If you are pro se (you don't have an attorney) then the attorney can talk to you. You need to hire an attorney & talk to that attorney about what has happened so far in your divorce. You might be able to get the attorney removed if he was not clear that he did not represent you. I hope this helps. Look on this website and on www.avvo.com for an attorney in your area.
