My husband and I have filed a legal separation. He has moved out into an apartment and I have remained living in the home aquired during the marriage. His name is still on the mortgage and property taxes are due. I say he must pay half since he still owns the home. He disagrees and is refusing to pay any amount. We live in the state if IN..who is correct in this situation?

Whatever court document provides for you to have possession of the home, should have a clause in it concerning who is responsible for expenses related to the home.

a followup answer is that property taxes are paid in arrears in Indiana. In other words what you are paying now is for the second installment of 2012, so regardless, he should be paying.
