My mother passed away unexpectedly without a will. My father did not pass away, was still married to her at the time and had two children (my brother and I) with her. What percentage of their estate, if any, will legally be split between my brother and I? I ask primarily because my father has taken over everything, even selling assets that belonged to her without consulting either of us.
