Question

if a parent give the child to the other parent but than decides not to give the child back and keeps the child would it be considered kidnapping? They parenst were never married but had a verbal agrrangement. The father decided to keep the child because the mother decided to change the arrangement and let him see the child every other weekend. When the arrangement was they would rotate weeks.

Answer

If biological father did not legitimize child through a superior court Order, he has absolutely no right to keep child None, whatsoever

Answer

Unless the father has legitimized the child and has a court order for custody and visitation he has no right to see the child and is essentially a kidnapper, who can go to jail for interference with custody or kidnapping.
