Question

I was working at a bicycle shop and was out on a test ride with a new customer which was a common thing I did on the job. I was riding in the parking lot and I hit some water and crashed. I was injured and took a few days off. When I returned to work they asked if I was ok. I said I hurt but I think I am. They then fired me. I am having issues with my elbow from the accident and I have contacted them and have not got a reply. is this wrongful termination and what are my rights

Answer

You need to retain an experienced worker's compensation attorney to file a claim and application for benefits for your work-related injuries. You will be entitled to medical treatment , temporary disability benefits, a settlement for permanent disability and future medical treatment. As far as your termination, you can file a petition under Labor code 132(a) for wrongful termination. Feel free to call me at 213-388-7070 for a free consultation.
