In California, is it legal for a consumer to record a conversation they had with a sales associate to use as evidence? Also is it legal for a business to record a conversation they had with a consumer to use as evidence in a small claims court?
Answer
The consent of all parties to the conversation is required, otherwise the recording is a crime and of course totally inadmissible in court. Consent can be implied, however, such as when the business' voice system says your call may be recorded, and you then continue with the call.
