My son passed away. Does his son have rights to my estate? Or can I leave all to my daughter I am in Colorado

Question

My son passed away. Does his son have rights to my estate? Or can I leave all to my daughter

I am in Colorado

Answer

Unless you have a will prepared with the provisions you want, then yes, your deceased son's son has rights to your estate. The only way you can cut those off is by doing a will with an attorney who specializes in estate planning.

Answer

I agree with Mr. Greenburg. If you died without a will, your sons child would receive 50% of your estate (assuming you had two children).
