My father left undivided interest in a piece of property to myself, my brother, and my stepmother. The estate was probated, and a final accounting filed. There were no assetts other than the property. Come to find that there was a jugement against my father prior to death, and its still on record. How is that tied to the property, and can the judgement creditor still collect by selling the property. All mortgages and deeds of trust are satisfied of record. The property is worth far less than the judgement against him.



Answer

The judgment creditor should have been notified by he probate file. You should speak to the attorney who handled it and if no one, speak to a probate attorney...you may be in luck.
