Question

We have been living in an apartment for about 5 years now.We had a baby in January of 2013.Making 5 people on our lease. We signed a lease in September of 2013 with 5 people on our lease. Now it is time to renew our lease again and they tell us we cannot renew because we have 5 people living here.It is 1150 square feet with 2 bedrooms and 1 1/2 bedrooms. They sent us a letter about 2 months ago offering us to renew our lease.I still have the letter and I have my copy of the lease from last year that we signed with 5 people on it.Is there anything I can do?

Answer

You can ask them why but if they don't respond or the answer seems odd, time to do some research and/or hire an attorney, or consider moving on. It sounds like you know, however, which is that it is possible that local zoning ordinances in your community (Westmont based on 60559???) says that there is a maximum occupancy for a 1150 2-bedroom unit. You can check with the community zoning administrator, but that could be the reason, which is life-safety related. I'd start there.
