Hello. You should confer privately with an attorney so she/he can advise you. Assuming you presently have no court order, you need to initiate legal action which may include forming a stipulated agreement with the mother. Talk with your attorney: She/he will address child support issues with you, too.

I am afraid that if the child was born and you were not married, the mother is considered to be the default custodial parent. You have no enforceable rights unless or until you commence a custody and parenting time action to establish your rights.
