I am currently living in a motorhome on a property that is in foreclosure and is up for a public auction in 2 days. There is no written rental agreement just verbal. The deal was as long as my boyfriend and I helped the owner as needed, paid the electricity, water, propane and trash, we (dogs included) could live there. I have a couple pieces of mail that were sent to the property. I am hooked up to water and electricity. Do i have the same rights as a tenant in California that is living on a property that is being foreclosed? I have lived here for three years.



Answer

It does not sound to me like you are a bona fide tenant. A bona fide tenant is one who pays rent in exchange for occupying the property with the landlord's consent. If you were a bona fide tenant, you would be entitled to the benefits of the "Protecting Tenants at Foreclosure Act."
