ok what does a person do here when a room mate of 14 years steals all your possessions and property and the police refuse to pursue theft charges and the county attorney refuses to press charges. Took the women to court the judge ordered the women did not own everything on the property and I had just as much right to it and after being removed from my home for a year and judge gave her temporary possession, when I returned she trashed my house, and stole all of my property including my damn clothes and I am being told to take her to civil court that no one will help me press theft charges from the police to the; county attorney what does a person do then to get their vehicle, their clothes and property back when they do not follow and refuse to follow the iowa code of chapter 741 which this women has committed several of these crimes in this chapter. what do I do???
I don't have an answer for you. But you do have a remedy in civil court. You think she should be prosecuted. The county attorney says "No". Maybe you need an attorney.
My grandmother passed away and in her will it state that the house is to be divided amongst her four sons equally and can not be sold unless all parties agree.my question is what happens to my father's 1/4 of the money and 1 of my uncle's part of the money since they are both deceased and the two remaining children want to sell.does my father and uncle part of the money go to their kids who are living?
Where did your grandmother live at the time of her death? Most states have anti-lapse statutes if there is no provision in the will.
If I get what you are saying, your uncle and father died prior to your grandmother. Does the will say anything about what happens if a child predeceases here? If so, then that is who gets the property. If the will is silent and a child died before your grandmother, then the grandchildren would inherit the share of the deceased parent under the anti-lapse statute.
So if grandmother had a will which left her home to her 4 children, and 2 of them died before her and the will is silent as to what happens, then the 2 living children of your grandmother (your aunt/uncle), the children of your dead uncle (if any) and you and your siblings would all inherit. The uncle's children get 1/4 and you and your siblings would split 1/4 (unless the will specifies a per capital distribution rather than per stirpes).
Regarding sale of the property, I don't see how your grandmother's wishes would be enforceable. If 3 of the kids wanted to sell and 1 did not, then the 3 could seek partition and force a sale. But getting back to your issue - you, your siblings and your cousins would have to agree to the sale of the property. If the property is sold you and your siblings get 1/4 and your cousins (children of the dead uncle) get 1/4 and each of the living aunts/uncles get 1/4.

I purchused a vehicle from a dealership and the clutch went out within 5 months. The dealership had it towed to thier shop and charged us $700 for the repairs. We couldnt pay the full amount so they accepted $260 and released the vehicle. A few days later we recieved an invoice stating that the parts, repairs, and tow totaled $0.00 The invoice, to my knowledge, states the repairs were free. Are we entitled to a refund of the $260 down payment that they took before sending the invoice? We still have the original receipt from the initial payment.
This is a fact dependent issue and you haven't provided enough of the facts for any lawyer to be able to answer your question. You haven't provided the purchase agreement so we can't know if the agreement for purchase was "as-is". Lawyers need to read the terms of the purchase agreement to be able to express opinions about things affecting the terms of purchase. There may be other provisions that either provide or don't provide for any warranty. If there is a warranty what are the terms of the warranty. Warranties are not open ended but have limitations. What limitations does your agreement provide? And then probably more important than any other issue is whether this car was new or used/pre-owned. We would read the purchase agreement and the terms of warranty before considering state and federal consumer protection laws. Lastly, how do you drive and did you cause the damage to the clutch assembly rather than it being defective. If defective how and was the defect covered under the warranty.
