I need to know the law on being notified in case of death and sending divorce papers to a husband in Florida. When I notified the prison in which he is in , and this was there response to me.

Good morning Ms. Baker

Our office is in receipt of your e-mailed request to be listed as the emergency notification contact for inmate Jones. Unfortunately, this decision as to whom the contact is rests with the inmate. We cannot place your name as his contact from your request. You will need to contact inmate Jones and have him complete an inmate request should he wish to have you listed as his emergency contact.

I apologize that I cannot be of further assistance to you and this time. Thank you for allowing our office to serve you and your family.

He had a lawyer at one time , but again this attorney as of July 2013 , called and said he could not appear for the hearing. So needless to be said it has been reschedule once again after 7 years of trying to get this divorce.

I represent myself now and have for the last 6 years.

If he has been served with the suit papers it is his obligation to respond and appear. your DOM may proceed upon proof of service.

If he has not been served you can check the Florida DOC website and it discloses the current prison location for all inmates. Contact the prison for their Service of Process rules, usually the county sheriff handles for minimal fee.

Not sure what you are trying to accomplish here. If he was served in prison just send all correspondence to the prison and finish the divorce.
