I divorced 7 years ago in California and there are still spousal support arrears that are unpaid. I no longer receive spousal support. Is there a statute of limitations on collection of these arrears and what is the process to do so?



Answer

Unlike a regular civil judgment, an order for spousal support does not expire after 10 years. You are free to use the same methods, however, that are used to collect a regular civil judgment, such as bank levies, wage garnishment, and execution sales on property. You can also use contempt, but there is a limitations period on bringing contempt proceedings. I suggest you get some help from a competent family law attorney near you.
