Question

I have a teen dance club that I have operated for 2 years. Now, the local government has closed me down saying "that I don't have the appropriate permit" which I contend in false as described under my initial business license. Before closing me down I asked the Mayor for some sort of warrant, copy of code violation, cease and desist order , or any other documents to support his claim. I explained that I thought this was a civil matter that needed to adjudicated by the courts, but he refused to supply any documentation, and in fact, had law enforcement block entry to my business with the threat of a class 3 misdemeanor enforcement. Are they right?

Answer

How frustrating! Where is (was) the club located? You'll need to meet with an attorney (we'd be happy to chat with you). The key here is -- what is in your business license, and what were you trying to do at the club? What is the zoning where you are located, and what was actually occurring there?

Business licensing is a tricky science. It involves not only licensing laws, but also zoning requirements, and as you learned, politics.
