Question

My landlord is asking me to sign a lease with an embedded SCRA waiver. However, the lease still has the military clause. I want to make sure than in the event my husband, who is in the army, is relocated we will be able to break the lease. The landlord says that the waiver just prevents me from not paying rent if he gets deployed and them not beirng able to file charges.

Answer

I don't believe such a waiver would be enforceable. Both Federal law and state law protect servicemembers, no matter what a contract says.
