My husband and his brother became executors of their mother's estate when she died. My husband's brother died and now my husband is sole executor. His late brother's wife has recently gotten engaged to be married. Is she still entitled to her late husband's inheritance?



Answer

This depends upon the deceased brother's estate plan. If he left no will, the interest in his mother's estate is his separate property and would be distributed under the law of intestacy.

Assuming that all of the mother's debts were paid and they had no children, then the wife would get the entire interest. If they had children the children would share that with their mother.
